These Terms and Conditions ("Terms") govern your use of the Heartbeat Stacker mobile application (the "App") and participation in tournaments operated through the App. By creating an account and using the App, you agree to be bound by these Terms.
The promoter of all competitions is Heartbeat Stacker ("we", "us", "our"). Please read these Terms carefully before participating.
Heartbeat Stacker is a skill-based prize competition. The outcome of each game is determined entirely by the player's skill, including timing, precision, and reaction speed. No element of chance determines the winner.
This competition is not gambling. It falls within the exemption for skill-based competitions under Section 14(5) of the Gambling Act 2005. No licence from the Gambling Commission is required, as the competition does not constitute gaming, betting, or a lottery within the meaning of the Act.
All scores are subject to server-side verification, which replays the exact physics of each game session to confirm that the submitted score is accurate and was achieved through genuine play.

We reserve the right to verify your identity and age at any time, including before processing a prize payout. Failure to provide satisfactory verification may result in forfeiture of prizes and account suspension.
No purchase is necessary to enter a tournament. Each user receives one free entry per tournament per day. Additional entries may be earned by watching a short advertisement. There is no cost associated with watching an advertisement beyond your mobile data usage.
Tournaments open and close at the times displayed within the App. We reserve the right to extend, shorten, or cancel any tournament at our discretion, provided we give reasonable notice through the App.
Players are scored based on their performance in the stacking game. Higher precision and longer sustained play result in higher scores. A "perfect" placement (95% or greater overlap) triggers a speed pulse that rewards skilled play with bonus points.
All game sessions use a server-provided daily seed to ensure identical game conditions for all players within a tournament. This guarantees that all participants face the same level of challenge.
The winner of each tournament is the player with the highest verified score at the time the tournament closes. In the event of a tie, the player who submitted their score first (by timestamp) shall be deemed the winner.
All scores are subject to server-side replay verification. A score will only be counted if the server replay produces an identical result to the submitted score. Scores that fail verification are rejected and do not appear on the leaderboard.
Prize pools are funded by advertising revenue. The current prize pool for each tournament is displayed in the App and may increase as more players participate and watch advertisements.
Winners will be notified within the App. To claim a prize, the winner must have valid payout details on their account (either a UK bank account or PayPal email address). Prizes will be transferred within 14 business days of the tournament closing, subject to completion of any required verification checks.
The minimum payout threshold is £1. If a prize is below this threshold, it will be carried over to a future tournament.
Winners are solely responsible for any tax obligations arising from their prize winnings. We may be required to report prize payments to HMRC and may request your National Insurance number for prizes above applicable thresholds.
We maintain a zero-tolerance policy towards cheating. The following are strictly prohibited:
We employ multiple anti-cheating measures including, but not limited to: tap pattern analysis, device fingerprinting, IP address analysis, server-side physics replay, and actions-per-minute monitoring. Players flagged by these systems are subject to review, and confirmed violations will result in immediate disqualification, forfeiture of any prizes, and permanent account suspension.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or otherwise acted in a manner detrimental to the competition or other users.
You may terminate your account at any time through the Settings screen in the App, or by visiting our account deletion page. Upon termination, any outstanding verified prizes that have been confirmed but not yet paid will still be honoured, subject to our standard verification process.
All content within the App, including but not limited to graphics, code, game mechanics, animations, and text, is owned by Heartbeat Stacker or its licensors and is protected by copyright, trade mark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any part of the App without our prior written consent.
The App and tournaments are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free operation of the App. We shall not be liable for any loss of data, loss of profits, or any indirect, incidental, consequential, or punitive damages arising from your use of the App or participation in tournaments.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under English law.
We shall not be liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, government actions, network failures, power outages, or third-party service disruptions.
If you have a complaint or dispute regarding a tournament, please contact us at support@heartbeatstacker.app. We will endeavour to resolve all complaints within 14 business days.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your right to bring proceedings in the courts of your country of residence if different.
We may update these Terms from time to time. We will provide at least 30 days' notice of any material changes through the App. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the App and delete your account.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Heartbeat Stacker regarding your use of the App and participation in tournaments.
